Terms of Service

By downloading, installing, or using the Remembery mobile application and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

Remembery is a private memory-sharing platform that allows users to capture and share photos, videos, audio recordings, and other media with friends and family through private circles. The Service includes features such as memory sharing, circles, reactions, comments, memory requests, and smart notifications.

To use the Service, you must:

• Be at least 13 years of age
• Register with a valid phone number and provide accurate information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

You retain ownership of all content you share through the Service (“User Content”), including photos, videos, audio recordings, and text. By sharing User Content, you grant Remembery a limited, non-exclusive, royalty-free license to store, display, and distribute your content solely for the purpose of providing the Service to you and your chosen audience.

You are responsible for ensuring that your User Content:

• Does not infringe on any third-party intellectual property rights
• Does not contain illegal, harmful, or objectionable material
• Complies with all applicable laws and regulations
• Does not include content you do not have the right to share

We do not claim ownership of your User Content. When you delete content or your account, we will remove your content from our servers within a reasonable timeframe, except where retention is required by law.

When using the Service, you agree not to:

• Harass, bully, threaten, or intimidate other users
• Share content that is illegal, obscene, defamatory, or promotes violence
• Impersonate another person or misrepresent your identity
• Use the Service for any commercial purpose without our written consent
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated tools, bots, or scrapers to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload malware, viruses, or other harmful code
• Collect or harvest personal information of other users without consent

Remembery allows you to create and join circles to share memories with specific groups. You are responsible for managing your circle memberships and the content you share within them.

• Circle creators can add or remove members and manage circle settings
• Content shared within a circle is visible only to its members
• Members should respect the privacy of circle content and not share it outside the circle without consent from the original creator

The Service, including its design, features, logos, and underlying technology, is owned by Remembery and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The Remembery name, logo, and all related marks are trademarks of Remembery. You may not use our trademarks without our prior written permission.

You may delete your account at any time through the app settings. Upon deletion, your profile, circles you created, and associated content will be removed.

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in prohibited conduct, or if we reasonably believe your actions may cause legal liability or harm to other users.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

We are not responsible for any User Content shared through the Service. The views and opinions expressed in User Content are those of the individual users and do not represent our views.

To the maximum extent permitted by law, Remembery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims relating to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim, or $100, whichever is greater.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
